Management at Berkeley Vale have been using appalling methods to monitor performance ever since I have worked here said another worker.<br /><br />So the question is: What is going on at Berkeley Vale? Why are employees being monitored without their knowledge? What is happening to employees privacy in accordance with the Act? It is a health issue that affects all us employees and an issue that has the serious potential to affect the Australian public that consume Sanitarium Health Foods.</div><br /><div></div><div>We do not want pest controllers spraying during working hours and we want it cleaned up to the hygienic standards the public would expect of a food company let alone a 'health' food company.</div><br /><div></div><div>We call on Sanitarium to come 'clean' with the Australian public and we demand the plant be cleaned and sanitised safely <strong>whilst no production is in operation </strong>and no worker is subjected to these disgusting standards any longer. LUCRF is an industry superannuation fund that delivers great superannuation returns for NUW Union Members.<br /><br />Sanitarium Management have refused to allow the LUCRF Representative to come on site and give a presentation on superannuation for the benefit of sanitarium workers. <strong>Could it be that Sanitarium and their Management directly benefit by using Mercer?</strong> Why else would they only be prepared to allow workers to hear from one superannuation fund?<br /><br />Why would Sanitarium Management stop any employee from possibly achieving greater returns and better financial security for their family. Workers should be able to compare and decide for them and their families where they want their superannuation. All sanitarium workers should be demanding that they want to hear how LUCRF are performing.<br /><br />It is Sanitarium Workers and their families future that they should be able to decide what fund is financially best for them. Well now at Cooranbong, Management are 'misleading' workers that the upcoming Newcastle Show Day Public Holiday on Friday 11 April has been awarded by Sanitarium Management and not the NSW State Government's Department of Industrial Relations.

<br />In a Memo dated 3 April, advising employees of the Newcastle Show Public Holiday that was sent to all site employees from the Site Manager, Adam Burton, in his second paragraph states:

<br />"<em><em>While this Public Holiday is not applicable to all employees, the Company has decided, on this occasion, to make it available to all employees at the Cooranbong Manufacturing Unit".</em></em><em></em>

<br />Can you believe this? According to Mr Burton, this holiday is <strong>not applicable to all employees</strong> but <strong>Sanitarium has decided</strong> to make it available to all employees!

<br />No, No Mr Burton, the holiday has been gazetted by the NSW Department of Industrial Relations and their press statement says:

<br /> "<em>The NSW Department of Industrial Relations has gazetted Friday 11 April 2008 a local show day holiday for the Newcastle Show. The Show Day holiday will apply to the Newcastle and Lake Macquarie Local Government Areas."

<br /><em>This means that Sanitarium has made nothing available as suggested and that all employees are entitled to this holiday by LAW!

This effectively means that <span style="color:#ff0000;">Sanitarium has taken two hours pay from workers and their families at Easter</span> and other public holidays. <strong>This is just another example of their true 'Christian values'.<br /></strong><br />When the NUW Organiser, Garry Cripps questioned the unfairness of this decision, HR through Sanitarium's representative, Donna Wynn stated..."<em>We have a Employee Collective Agreement (ECA) at Berkeley Vale and the Award doesn't apply here.."</em> You heard it here! In other words, <strong>an agreement' that is designed to take away your rights and Award conditions</strong>...no wonder they had three attempts at 'ramming' it through at Berkeley Vale!<br /><br /><strong>So, why is it that Berkeley Vale works additional hours leading up the public holiday whilst Cooranbong works shorter hours?</strong><br /><br />The answer is very simple...Berkeley Vale workers voted to support a Non-Union Agreement twice since 2003 and <strong>have lost their RIGHTS and AWARD conditions.</strong><br /><br /><strong>The lesson here is obvious</strong>...Whilst ever workers' support any management supported agreement on employment conditions, <strong>without a UNION</strong> <strong>SIGNED</strong> <strong>AGREEMENT</strong>, <strong>YOU WILL LOSE YOUR RIGHTS AND YOUR AWARD CONDITIONS!</strong><br /><br />Let this lesson in another example of <strong>Sanitarium greed</strong> be even more reason to build a stronger <strong>UNION</strong> at Cooranbong and to be active so that workers never have to give away their <strong>RIGHTS and Award Conditions like Berkeley Vale</strong>.<br /><br />We have retained our P/H conditions at Cooranbong to work less hours prior to the public holiday by taking a stand and then acting on it with strong union support. In order to maintain this along with other rights and conditions, workers must fight for a <strong>UNION AGREEMENT!</strong><br /><strong></strong><br /><strong>Unity at Cooranbong is great to see....great work to all union members!</strong><br /><br />1. In a bitter response to the federal election result, they have now issued common law contracts to Award employees at Cooranbong in a desperate attempt to keep alive John Howard's Workchoices corpse with his AWA principles of removing workers conditions in mean spirited move by once again hurting Sanitarium Employees and their families who are already struggling to meet their needs.<br /><br /><div></div><div>By issuing common law individual contracts, they are attempting to force the minimum standards under the Howard Government's 'WorkChoices' legislation to avoid having employees covered under a union collective agreement. This is purely aimed at reducing employees current conditions of employment and guaranteeing that employees are excluded from any collective agreement under the proposed Labor Government's IR changes which seeks to restore the balance and fairness in collective bargaining which is a key part of the policy platform.</div><br /><div></div><div></div><div>In correspondence sent to the union from Sanitarium's Group Human Resources Manager - Donna Bailey states: <em>"We note that we have recently had a change of Government. As it moves away from the use of AWA's, the new Labor Government has foreshadowed an increased role for its "Forward with Fairness" policy platform."</em></div><br /><div></div><div>This is in our view a sneaky and grubby attempt to now use common law contracts to hurt these minimum award Sanitarium employees by removing and further slashing their conditions of employment. This has nothing to do with common law contracts under a Rudd Labor Government. Common law contracts have been invariably used at the high end of town, not for workers who are on as little as $16 per hour. <strong><span style="color:#990000;">No Worker should sign any contract that seeks to remove conditions like this does!</span></strong></div><br /><div></div><div>As usual, the union has immediately attempted and offered to meet Sanitarium Management to give them the opportunity to explain their position and as usual has refused that request.</div><div></div><div><strong></strong></div><div><strong></strong></div><div><strong>Join the Sanitarium Campaign</strong> to bring justice for these workers and their families. These workers by agreeing to accept a non-union agreement has allowed Sanitarium to prevent the union coming on site to represent or speak to its members. <strong>Cooranbong Management now intend to hurt their workers in the same way but you can put a stop to this by fighting back and supporting your UNION. </strong></p><p align="left"><span style="color:#990000;"><strong>Let's Never forget Sanitarium's real agenda:</strong></span></p><p align="left">1. Get an unenforcable agreement where your rights and conditions can be taken away at any time after you accept the 'Employee Agreement'.</p><p align="left">2. Giving up some time on weekends has been worthwhile and we thank all those who have been helping outside of work hours.<br /><br />This is the first step in a sustained campaign for Sanitarium to finally recognise workers want real change and putting in place fair company policies and procedures in dealing with workers' industrial and safety rights. These issues however will only be resolved when the company recognises workers' have a legitimate right to have their union present in representing us and having communication structures in place to deal with issues that are affecting workers.<br /><br />The Union welcomes the decision and looks forward to having genuine discussions and negotiations with site Management if this is the direction new management are prepared to pursue. The real test though will come when the company has to make a public decision whether they will accept their workers' legitimate right to collectively bargain for an agreement. The majority are union members and 80% have signed a petition for a union agreement. They have been contacted by many people recently regarding the unfair work practices at Sanitarium. None have responded to the Union, on site delegates or their Workers to any calls or written correspondence they have recieved lately. It would seem that they respond to positive feedback regarding the profitabilty of the company or how the company supports the general community. What about the workforce who deliver the company profits?..Have any of them got time to address our concerns and the fact that we are hurting at Sanitarium. We are the very community Sanitarium often talk about but ignore! We demand a fair go NOW!<br /><br />We extend this open invitation for any member of our senior management to attend an open forum to address our concerns in the community. We also want to know why they refuse our rights to be represented by our union whilst at the same time management have engaged two highly paid Solicitors (Fisher, Cartwright Berriman) on retainer. Is this law firm simply profiting of workers misery? Sanitarium does have a Human Resources Dept that apparently doesn't deal with Human related issues!<br /><br />Does the Seventh Day Adventist Church really support Sanitarium's policies that hurt our families? How about reducing our wages when we get hurt whilst working at Sanitarium? Doesn't sound very christian to us that Sanitarium profits off injured workers!<br /><br />The Church however may not even be aware of what is happening to us but here is their chance to come out and support us. Are there members' of the Seventh Day Adventist Church <a href="http://adventist.org.au/">http://adventist.org.au/</a> that are prepared to speak out against these unfair work practices? Does the SDA Church support the Howard Government's Workchoices Legislation? It would seem they do if you have a look at our sick leave conditions that have also been eroded away even when Sanitarium was under no obligation to do so, even under the current Legislation.<br /><br />We are organising a Community Forum to address our concerns along with other IR issues at Sanitarium and the real role Sanitarium plays in OUR community. No one would argue if a company is pouring all of the profits they make into charity but there is no accountability as to where the profits go (Est A$300 Mil) in 2006 alone. For us though, it is not about profits it is about fairness and respect along with our rights.</p><p>Many workers are loyal to the Church and the community but when it comes to supporting us as a community we are forgotten and ignored. Our wages alone are the lowest across all of our competitors and we have no agreement in place that either protects our conditions or improves our standards of living when compared to other workers. The company policies are unfair with the workers compensation and sick leave policies hurt us and our families.
